[UPDATE: Reply from CYC on 22.2.23 ref timings said: "The development has to be commenced within 3 years of the permission. There is no date at which the works have to be completed once commenced." On 14.4.23 a friend took photos looking towards the site showing how it looks pre-development: #192965.]

[UPDATE: 24.11.22 I received this information in an email dated Wednesday, 23 November 2022. Cllr. A. D'Agorne (Deputy Leader of the Council, Executive Member for Transport, Leader of the Green Group) wrote:
"Happy to work with you. [NB I don't know if he meant me or the Councillors I have been emailing about this. Or both] On this one, both Ian Stokes and Neil Massey have said they will not be expecting any financial contribution from the developers. On that basis CYC would need to find the money to rectify the design failings at the junction."

[UPDATE 23.11.22: I submitted a FoI relating to the site/the planning application. The reply arrived today. I have pasted the responses into the end of this caption.]

[Image taken 28.6.21] Denning’s Yard access, York (between the junction of Crichton Avenue and Wigginton Road.) The site (known as Denning’s Yard) behind the camera is the subject of a planning application: 21-01154-FUL. The plans are for three three-bed and six four-bed townhouses. The submission on behalf of the developers makes no specific mention of the number of 'humans' who cross the mouth of the access to the site. So today between 8.13 and 9.13, I did a count. The weather was dry, it was daylight, visibility was good. England was still in Step 3 of the covid regulations (www.gov.uk/guidance/covid-19-coronavirus-restrictions-what-you-can-and-cannot-do) All schools were open so pupils and their families were moving around. Unis have closed for the summer. Staff are working from home. This means at other times of the year there may have been students using this crossing. Further, people are still asked to work from home: "Going to work. You should continue to work from home where you can. Employers and employees should discuss their working arrangements, and employers should take every possible step to facilitate their employees working from home, including providing suitable IT and equipment to enable remote working. Where people cannot work from home, employers should take steps to make their workplaces COVID-19 secure and help employees avoid busy times and routes on public transport." This means it was likely there were fewer people going to work on foot, cycle, or heading to the train or bus stations.

COUNT RESULT: In 60 minutes 267 people crossed. Thus included babies in buggies, infants in pushchairs and children in trailers.

The Traffic and Transport Engineer for the company that wrote the TRANSPORT_STATEMENT-2363695.pdf clarified: "The version of TRICS used was 7.8.1 which was released in March 2021 and the data taken from 01/072012 to 08/11/2019 surveys as this provides worst case conditions."
"The junction analysis works were conducted by CYC and they would have examined all pedestrian movements at this location to arrive at the junction upgrade works they recently implemented."
"Survey data was provided by CYC. PCU’s include all vehicles, pedal cycles and motorcycles travelling in all directions along the road. All pedestrian (including mobility impaired) and pedal cycle road crossing movements would have been included in CYC’s calculations and used to arrive at the junction upgrade recently implemented."
I submitted a FoI request to CYC. Among other questions I asked: "Did you do a separate count of 'people' movements across the mouth of the access to the site (Denning's Yard access) including both between Crichton Avenue off-road cycle-pedestrian-wheelchair path and the entry to/exit from the Foss Islands Way and between Crichton Avenue off-road cycle-pedestrian-wheelchair path and the pavement on the Denning's Lane side of Wigginton Road?" and "What is the breakdown of users for people crossing Denning's Yard access?"
On 26.7.21 I received a reply which included:
"Response: Please see attached traffic surveys that were used in the assessment for the TSAR scheme at Wigginton Road / Crichton Avenue. These surveys were undertaken on 14th September 2016 but did not include any traffic (or pedestrain) counts for the Denning’s scrap yard arm. We did get traffic hourly counts for the Denning’s scrap yard arm on the 6th October 2020 by the Network Monitoring Officer using CCTV. However, this did not include pedestrian or cyclist counts for this arm of the junction."
I have also chased CYC for the results of the stage 3 safety audit of the changes - the installation of the bollards - which would have been done in 2018.

The plans and documents are submitted by the developer and they have not proposed any alterations to the route.

Please tell me what sums CYC will ask the developers of that site to pay (Section 106 or other?) and what the money will be used for.

This has yet to be finalised. A sum of £6000 has been sought by Highway Network Management as a contribution towards a Traffic Regulation Order and works to restrict car parking on the access road.

Your request seeks information which would identify individuals. The council has completed a Public Interest test and concluded that individual’s names, are considered to be personal data. Such information is considered to fall under an exception in the EIR at regulation 12(3) relating to other people’s personal data. The weight of public interest is in maintaining the exception for members of staff below Head of Service level and the requested information has been withheld.
The date and duration of any site visit is not recorded.

The S106 (draft document I saw, 22.2.23) refers to two car parking spaces for allotment users "in perpetuity". It talks about bio diversity - trees, hedgehogs. There's no reference to humans who rely on the route for every type of journey you need to make.
